These terms and conditions ("Terms") govern access to and use of the platform owned by BV Maurice Hulp ("Platform"), available via the mobile application and/or website, and the services offered through the Platform. By creating a user account or using the services of BV Maurice Hulp, you confirm that you have read and agree to these Terms. If you do not agree to these Terms or the Privacy Policy of BV Maurice Hulp, you should not use the services. These Terms apply to the exclusion of any other terms (unless explicitly agreed otherwise in writing and approved by Maurice).
1. Definitions
In these Terms, the following terms have the following meanings:
- Maurice & Nora: the trade name of BV Maurice Hulp, with registered office at Teichmannstraat 2, bus 301 2018 Antwerp and registered with the Crossroads Bank for Enterprises under number 1023.021.881.
- Platform: the mobile application and/or website owned by BV Maurice Hulp, on which Users are connected with each other.
- User: any natural person registering on the Platform, either as Helper, Customer or their legal representative.
- Customer: the person using the Platform to request assistance, or their legal representative.
- Helper: the student or young adult providing assistance to Customer(s) via the Platform.
- Services: the services offered via the Platform, including but not limited to facilitating connections between Customers and Helpers.
- Agreement: the contractual relationship between Maurice and the User arising upon registration on the Platform, whereby the User explicitly accepts these Terms.
2. Purpose and nature of the Platform
Maurice & Nora is a platform that connects Customers and Helpers. BV Maurice Hulp acts solely as an intermediary and does not provide assistance services itself. The actual assistance takes place between the Customer and the Helper. BV Maurice Hulp will make reasonable efforts to create quality matches but cannot guarantee a match will always be successful.
3. Registration and account management
3.1 Access and registration
- Users must register via the Platform to access the Services and declare that all information provided is accurate, truthful and complete.
- Only natural persons over 18 may register. BV Maurice Hulp may request proof of age.
- Customers may register themselves or via a legal representative.
- It is prohibited to use an alias or someone else’s identity, to create multiple profiles, or to use another User’s profile.
3.2 Profile
- Users can update their profile at any time and are responsible for keeping it up to date.
- Helpers can set their status to temporarily or permanently unavailable; in that case they will not receive invitations.
3.3 Account security
Users are responsible for the confidentiality of their login credentials and all activity under their account.
3.4 Verification
- BV Maurice Hulp reserves the right, without obligation, to request and verify identity, diplomas, insurance or other documents of Helpers and Customers.
- BV Maurice Hulp may remove profiles suspected of incorrect or false data (or where evidence is not provided) and may deny access to the Platform, temporarily or permanently, without notice or compensation.
4. Use of the Platform
4.1 Code of conduct
- Users must behave respectfully and with integrity toward one another.
- Helpers commit to provide assistance in a safe, reliable and respectful manner.
- Customers respect Helpers’ boundaries and provide a safe working environment.
4.2 Prohibited use
- It is prohibited to use the Platform for illegal, unethical or harmful purposes.
- Users may not post content that is defamatory, discriminatory, hateful or otherwise inappropriate.
5. Compensation and payment
5.1 Rates
- Customers pay a fee to Maurice, which is then paid to the Helper after deducting an administrative fee.
- Payments must be made within fourteen (14) calendar days after the service is completed.
- BV Maurice Hulp determines prices within the Platform and may adjust them. The Customer decides at booking whether to accept the price.
5.2 Payment process
All payments are processed via payment providers with whom BV Maurice Hulp cooperates. BV Maurice Hulp is not liable for delays or errors of the payment provider.
5.3 Free first reminder
If the consumer-customer does not pay by the due date, a first reminder is sent free of charge by email or mail.
5.4 Term after reminder
If payment is not made within 14 calendar days after the reminder, the following amounts apply under Book XIX of the Economic Law Code:
- €20 for invoices up to €150,
- €30 for invoices above €150 up to €300,
- 10% of the invoice amount above €300, with a maximum of €200.
6. Gift card
Users may purchase a gift card via the BV Maurice Hulp website for themselves, another User or a not-yet-registered recipient, to request assistance via BV Maurice Hulp.
The gift card can be purchased for a value of choice (from 25 EUR) as indicated on the gift card.
Unless explicitly stated otherwise, a gift card is valid for one year after purchase. If not fully used within one year, it cannot be exchanged or refunded.
Users can withdraw the purchase of a gift card without giving reasons by email to BV Maurice Hulp within fourteen (14) days. BV Maurice Hulp will refund the payment received within fourteen (14) days after receiving the withdrawal.
7. Cancellation and no-show policy
7.1 Cancellation
The Customer or Helper may cancel scheduled assistance. If this occurs within 48 hours before the scheduled start, a cancellation fee equal to 50% of the agreed fee will be charged to compensate lost income for the Helper.
7.2 No-show
If a Helper fails to show up without valid reason for a scheduled and confirmed assignment, BV Maurice Hulp may impose sanctions including temporary or permanent exclusion. Additionally, a fee equal to the value of the missed hours will be charged, based on the agreed hourly rate, with a minimum of €20. This fee is due immediately without notice.
8. Liability and indemnity
8.1 Limitation of liability
- BV Maurice Hulp makes reasonable efforts to provide the Services without interruption but is not liable for damages due to unavailability of the Platform or loss of data provided via the Platform.
- BV Maurice Hulp is not liable for the performance of the assistance or any resulting damage; it only acts as intermediary connecting Users via the Platform.
8.2 Indemnity
Users indemnify BV Maurice Hulp against all third‑party claims arising from use of the Platform, including claims for damages, injuries or losses.
9. Non‑circumvention and damages
9.1 Prohibition on direct cooperation outside the Platform
Any Helper who comes into contact with a Customer via the Platform undertakes not to offer similar services outside the Platform, directly or indirectly, during the collaboration and for twelve (12) months after the last service performed via the Platform.
9.2 Prohibition on active solicitation
Helpers may not actively approach Customers in order to:
- offer assistance outside the Platform, or
- encourage the Customer to stop using the Platform or the services of BV Maurice Hulp.
9.3 Lump‑sum damages
For breach of Articles 9.1 and/or 9.2, the Helper owes BV Maurice Hulp a lump‑sum compensation of five thousand euros (5,000.00 EUR) per breach, without prejudice to BV Maurice Hulp’s right to claim higher actual damages.
9.4 Objective justification
This non‑circumvention clause is necessary to protect BV Maurice Hulp’s business model and to prevent Helpers from using the Platform merely as a lead‑generation tool without consideration, taking into account:
- investments in marketing, selection and matching of Users;
- continuity of insurance and quality guarantees for Customers;
- prevention of unfair competition and safeguarding platform viability.
10. Duration and termination
10.1 Termination by the User
Users may terminate the Agreement at any time by closing their account.
10.2 Suspension or termination by BV Maurice Hulp
BV Maurice Hulp may suspend or terminate access to the Platform in case of:
- Breach of these Terms;
- Inappropriate behavior; and/or
- Abuse of the Platform.
10.3 Consequences of termination
Upon termination by any party, the User must immediately pay all outstanding amounts. BV Maurice Hulp reserves all rights to collect such amounts.
11. Personal data and privacy
BV Maurice Hulp processes personal data in accordance with the Privacy Statement, which forms an integral part of these Terms. Maurice takes data protection seriously and acts in accordance with applicable law, including the GDPR.
12. Intellectual property
All rights relating to the Platform, the name “Maurice & Nora”, logos, software and content belong to BV Maurice Hulp or its licensors. Users obtain only a limited, revocable, non‑exclusive right of use.
13. Changes to the Terms
BV Maurice Hulp reserves the right to modify these Terms at any time. Users will be informed via the Platform or by email before the effective date. If the User does not agree, they may close their account in accordance with Article 10. Continued use after the effective date implies acceptance.
14. Partial invalidity
If any provision of these Terms is found to be wholly or partially invalid or unenforceable, the remaining provisions remain fully in force. The invalid provision will be replaced by one that most closely reflects the intent of the original provision, insofar as permitted by law.
15. Applicable law and disputes
These Terms are governed exclusively by Belgian law. In the event of a dispute, the courts of the Antwerp district shall have exclusive jurisdiction, unless mandatory law provides otherwise.
